By accessing or using iCarry, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

These Terms constitute a legally binding agreement between you and iCarry. Your continued use of the platform signifies your acceptance of any modifications to these Terms.

2. Service Description

iCarry operates as a peer-to-peer marketplace platform connecting senders who need items delivered between continents with verified travelers making those journeys.

Our platform provides:

  • Matching services between senders and travelers
  • Secure messaging and communication tools
  • Payment processing and escrow services
  • Identity verification and trust features
  • Dispute resolution support
3. User Responsibilities

As a Sender, you agree to:

  • Provide accurate descriptions of items to be delivered
  • Ensure items comply with all applicable customs and aviation regulations
  • Not send prohibited or restricted items
  • Pay agreed-upon delivery fees promptly
  • Communicate clearly and professionally with travelers
  • Confirm delivery upon receipt of items

As a Traveler, you agree to:

  • Transport items safely and securely
  • Deliver items within agreed timeframes
  • Comply with all customs and aviation regulations
  • Communicate any delays or issues promptly
  • Handle items with reasonable care
  • Confirm pickup and delivery of items

All users agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Verify your phone number and, when required, provide additional identity verification
  • Comply with all applicable laws and regulations
  • Not engage in fraudulent or deceptive practices
  • Respect the rights and safety of other users
4. Prohibited Items and Activities

The following items and activities are strictly prohibited on iCarry:

Prohibited Items:

  • Illegal drugs, narcotics, or controlled substances
  • Weapons, firearms, ammunition, or explosives
  • Hazardous materials or dangerous goods
  • Counterfeit goods or stolen property
  • Items that violate intellectual property rights
  • Perishable food items without proper packaging
  • Live animals or plants
  • Currency exceeding legal limits for international transport
  • Pornographic or obscene materials
  • Any items prohibited by customs or aviation authorities

Prohibited Activities:

  • Using the platform for illegal purposes
  • Attempting to defraud other users or iCarry
  • Harassing, threatening, or abusing other users
  • Creating multiple accounts to circumvent restrictions
  • Manipulating reviews or ratings
  • Sharing account credentials with others
  • Scraping or data mining platform content
  • Interfering with platform operations or security
5. Payments and Fees

iCarry facilitates secure payment processing between users:

  • Senders pay delivery fees to travelers plus iCarry service fees
  • All payments are held in escrow until successful delivery confirmation
  • iCarry uses secure payment processing
  • We do not store full payment card details
  • Service fees cover payment processing, insurance, platform maintenance, and support

Payments are released to travelers after the recipient confirms delivery. If delivery cannot be completed, refunds are processed according to our dispute resolution procedures.

Users are responsible for any applicable taxes, customs duties, or fees associated with international deliveries. iCarry is not responsible for customs clearance or import duties.

6. Limitation of Liability

iCarry operates as a platform connecting users and does not directly provide delivery services. We are not a carrier, shipper, or logistics provider.

While we implement verification and safety measures, iCarry cannot guarantee the conduct of users or the condition of items during transport. Users engage with each other at their own risk.

To the maximum extent permitted by law, iCarry shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the platform.

Our total liability for any claims arising from your use of iCarry shall not exceed the amount of fees you paid to iCarry in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

7. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using iCarry, you also agree to our Privacy Policy.

We use bank-level encryption to protect your data and comply with applicable data protection regulations including GDPR where applicable. Your personal information is shared with other users only as necessary to facilitate deliveries.

8. Dispute Resolution

If a dispute arises between users:

  • Contact our support team immediately at support@icarry.app
  • Provide relevant documentation, photos, and communication records
  • Cooperate with our mediation process
  • Allow up to 10 business days for investigation and resolution

iCarry will review all evidence and make fair determinations regarding refunds, partial refunds, or payment releases. Our decisions on disputes are final.

For disputes with iCarry itself, you agree to first attempt resolution through good faith negotiation. Any legal disputes shall be governed by the laws of the jurisdiction where iCarry is registered and subject to the exclusive jurisdiction of courts in that location.

9. Account Termination

You may terminate your account at any time by contacting support. Upon termination, you will no longer have access to the platform, but certain information may be retained as required by law or for legitimate business purposes.

iCarry reserves the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or conduct that harms other users or the platform. We may also terminate accounts that remain inactive for extended periods.

If your account is terminated for violations, you may forfeit pending payments and lose access to dispute resolution services. Termination does not relieve you of obligations for pending transactions.

10. Changes to Terms

iCarry reserves the right to modify these Terms of Service at any time. We will notify users of material changes via email or prominent platform notices.

Your continued use of iCarry after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the platform and may terminate your account.
